Terms & Conditions

Please read these Terms and Conditions ("Terms") carefully before registering for any program, using our website, or participating in any activity offered by Aquatics 4 Life Inc. ("Aquatics 4 Life," "we," "us," or "our"). By registering, participating, or using our website, you agree to be bound by these Terms. If you do not agree, please do not register or participate.

For participants under the age of 18, a parent or legal guardian must review and accept these Terms on their behalf.

1.  About Aquatics 4 Life Inc.

Aquatics 4 Life Inc. is a nonprofit organization incorporated in the State of Texas. Our mission is to empower individuals with the knowledge, skills, and confidence to navigate aquatic environments safely and to reduce the incidence of fatal and non-fatal drownings in our community. Our current programs and services include:

  • Swimming Lesson Access Program: Aquatics 4 Life partners with qualified local swim instruction providers to connect individuals and families — particularly those from underserved communities — with swimming lessons. We provide financial assistance and subsidy coordination to remove cost as a barrier to access. Swim instruction is delivered by our vetted partner organizations.

  • Water Safety Workshops (including CPR and first-aid basics)

  • Lifeguard and Water Safety Instructor Certification Courses

  • Community Outreach Initiatives and Mobile Aquatics Training

Note: Aquatics 4 Life Inc. may offer direct swimming instruction in the future. These Terms will be updated accordingly at that time.

2.  Eligibility and Registration

2.1  Age Requirements

Programs are open to participants of all ages unless otherwise specified. Participants under the age of 18 must have a parent or legal guardian complete all registration forms and provide written consent prior to participation.

2.2  Registration Information

To register for our programs, you may be required to provide:

  • Full legal name and date of birth

  • Contact information (address, phone number, email address)

  • Emergency contact information

  • Medical information relevant to safe participation (e.g., allergies, disabilities)

  • Parent or guardian information for minor participants

You agree to provide accurate, complete, and current information. Aquatics 4 Life reserves the right to refuse registration or remove any participant who provides false or misleading information.

 

3.  Fees, Payment, and Refunds

3.1  Program Fees

Some programs are offered free of charge or at subsidized rates through community partnerships. Where fees apply, they will be clearly stated at the time of registration. Fees are due at the time of registration unless other arrangements are made in writing.

3.2  Third-Party Lesson Providers

When Aquatics 4 Life facilitates access to swimming lessons through a partner organization, any fees paid to that partner are subject to the partner’s own refund and cancellation policies. Aquatics 4 Life is not responsible for fees paid directly to third-party providers.

3.3  Refunds and Cancellations

Refund and cancellation policies vary by program. Specific refund terms will be provided at the time of registration. In general:

  • Cancellations made at least 7 days before a program begins may be eligible for a full or partial refund.

  • Cancellations made less than 7 days before a program begins may not be eligible for a refund.

  • Aquatics 4 Life reserves the right to cancel or reschedule programs due to insufficient enrollment, weather, facility issues, or other circumstances. In such cases, participants will receive a full refund or the option to transfer to another session.

 

4.  Scholarship Recipient Commitments

4.1  Purpose

Aquatics 4 Life Inc. provides financial assistance to individuals and families who would not otherwise be able to access swimming lessons. To ensure that scholarship resources are used effectively and that recipients are genuinely committed to completing their program, Aquatics 4 Life requires scholarship recipients to fulfill one of the following accountability commitments prior to or at the time of enrollment.

4.2  Accountability Options

Aquatics 4 Life will determine which of the following options applies to each scholarship recipient at the time of award. In some cases, recipients may be offered a choice between the two options.

Option A — Volunteer Service Hours

The recipient agrees to complete [X] hours of volunteer service with Aquatics 4 Life Inc. Volunteer hours must be completed within [X months] of the scholarship award date, or as otherwise specified in the recipient’s scholarship agreement. Volunteer activities will be assigned by Aquatics 4 Life and may include event support, community outreach, administrative assistance, or similar tasks. For recipients under the age of 18, volunteer service must be approved by and coordinated with a parent or legal guardian.

Option B — Refundable Deposit

The recipient (or, for minors, a parent or legal guardian) pays a refundable deposit of $[X] at the time of enrollment. This deposit will be returned in full upon the recipient’s successful completion of the lesson program, as confirmed by the partner instruction provider. The deposit is held by Aquatics 4 Life Inc. and is not applied toward any lesson fees.

4.3  Forfeiture of Deposit

The deposit will not be returned if the recipient:

  • Voluntarily withdraws from the lesson program without completing it.

  • Is removed from the program due to a violation of these Terms or program conduct standards.

  • Fails to attend [X] or more scheduled lessons without prior notice and documented reason acceptable to Aquatics 4 Life.

Forfeited deposits will be directed back into Aquatics 4 Life’s scholarship fund to benefit future recipients.

4.4  Extenuating Circumstances

Aquatics 4 Life recognizes that unexpected events may prevent a recipient from completing their program. In cases of serious illness, family emergency, or other extenuating circumstances, recipients (or their guardian) may submit a written request for a deposit refund or extension of volunteer service hours. All such requests are reviewed at the sole discretion of Aquatics 4 Life Inc.

Note: The deposit and volunteer service provisions above involve financial and legal commitments. Aquatics 4 Life Inc. is encouraged to consult a Texas attorney before implementing these provisions, particularly regarding how deposits are held, defined completion standards, and enforceability for minor participants.

 

5.  Assumption of Risk and Release of Liability

4.1  Inherent Risks

Participation in aquatic activities involves inherent risks, including but not limited to: drowning, near-drowning, physical injury, illness, or death. By registering and participating, you (and for minor participants, the parent or guardian on behalf of the minor) voluntarily acknowledge and accept these risks.

4.2  Release of Liability

To the fullest extent permitted by applicable Texas law, you release, waive, and discharge Aquatics 4 Life Inc, its officers, directors, employees, volunteers, instructors, and agents (collectively, "Released Parties") from any and all claims, liabilities, demands, or causes of action arising out of or relating to participation in our programs, including claims resulting from the negligence of the Released Parties.

4.3  Third-Party Providers

Where swimming lessons or other activities are delivered by a partner organization, that organization is solely responsible for the safety, supervision, and conduct of those activities. Aquatics 4 Life does not supervise, control, or assume liability for the actions or omissions of third-party instructors or facilities.

4.4  Medical Responsibility

You represent that all participants are physically and medically able to participate in the enrolled program. You agree to disclose any medical conditions, disabilities, or allergies that may affect safe participation. In the event of a medical emergency, Aquatics 4 Life staff may seek emergency medical assistance on behalf of any participant, and you authorize such assistance.

Note: This release of liability may not apply in all circumstances. Texas law imposes certain limitations on liability waivers, particularly those involving minors. We strongly recommend you seek independent legal counsel if you have questions about your rights.

 

6.  Conduct and Participant Responsibilities

All participants and accompanying adults are expected to:

  • Follow the instructions of all Aquatics 4 Life staff and instructors at all times.

  • Behave respectfully toward other participants, staff, and facility property.

  • Arrive on time and appropriately prepared (e.g., appropriate swimwear, towels).

  • Refrain from behavior that may endanger themselves or others.

  • Disclose any medical conditions or physical limitations that may affect participation.

  • Not participate while under the influence of alcohol or drugs.

Aquatics 4 Life reserves the right to remove any participant from a program for failure to comply with these standards, without refund.

 

7.  Privacy and Data Collection

7.1  Information We Collect

We collect personal information solely for the purpose of program registration, administration, safety, and communication. This includes contact details, emergency contact information, and relevant health information. We do not sell or share your personal information with third parties for commercial purposes.

7.2  Minor Participants

We take the privacy of minors seriously. Personal information relating to minor participants will be collected from and managed by their parent or legal guardian. We will not collect personal information directly from minors under the age of 13 without verifiable parental consent, in accordance with applicable law.

7.3  Photography and Media

Aquatics 4 Life may photograph or record participants during programs for use in educational materials, marketing, and public awareness campaigns. If you do not wish to be photographed or recorded, please notify us in writing at the time of registration. Separate consent is required for the use of any images or recordings of minor participants.

A separate Privacy Policy may be published on our website and is incorporated into these Terms by reference.

 

8.  Website Use

Our website is provided for informational purposes and to facilitate program registration. You agree not to:

  • Use the website for any unlawful purpose.

  • Attempt to gain unauthorized access to any part of the website or its systems.

  • Submit false or misleading information through any website form.

  • Distribute spam, malware, or other harmful content through the website.

Aquatics 4 Life does not guarantee that the website will be available at all times, free from errors, or free from viruses or other harmful components.

 

9.  Intellectual Property

All content on our website and in our programs — including text, images, logos, curriculum materials, and program resources — is the property of Aquatics 4 Life Inc. or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any such content without prior written permission.

 

10.  Indemnification

You agree to indemnify, defend, and hold harmless Aquatics 4 Life Inc. and its Released Parties from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from: (a) your breach of these Terms; (b) your participation in any program; (c) any false or inaccurate information you provided; or (d) any violation of applicable law by you.

 

11.  Limitation of Liability

To the maximum extent permitted by Texas law, Aquatics 4 Life Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your participation in our programs or use of our website, even if advised of the possibility of such damages.

 

12.  Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or your participation in our programs shall be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.

 

13.  Changes to These Terms

Aquatics 4 Life Inc reserves the right to update or modify these Terms at any time. Changes will be posted on our website with a revised effective date. Your continued participation in our programs or use of our website after any changes constitutes your acceptance of the updated Terms.
